Early Neutral Evaluation is a form of Alternative Dispute Resolution in which an independent and impartial evaluator is appointed to give the parties an assessment of the merits of their case.
The aim of an ENE is to provide the parties with an objective and realistic view of the strengths and weaknesses of their respective cases, and to serve as a basis for negotiation.
The process is voluntary, and can only be carried out with all parties agreement. It does not eliminate other dispute resolution options. The ENE is usually non-binding and the process is without prejudice.
The evaluator expresses a view on what the outcome would be if the matter proceeded to a formal dispute resolution process (usually litigation or arbitration) the evaluator does not resolve the dispute per se, and has no power to impose settlement, and does not attempt to force a party to accept settlement terms.
ENE can be used as a standalone dispute resolution method, where the parties attempt to settle the dispute immediately following the ENE or alternatively, it can be used as part of a package of dispute resolution processes for example ENE followed by mediation.
